What is a construction contract?


Construction contract law relates to the contractual relationship between the construction contractor and the principal, where the contractor is often tasked with carrying out work. Construction contract law also relates to the relationship between construction contractors and subcontractors, and to the purchases made with regard to materials for a construction project. The contractual relationship with technical consultants is also covered by construction contract law, as are issues relating to general contract law, and to procedural and evidentiary issues.

Construction contract law is not regulated by special legislation, with the area regulated primarily through the industry’s own standard agreements. The standard agreements to which clients and construction contractors often refer in construction contracts are General Conditions of Contract for Design and Construct Contracts for Building, Civil Engineering and Installation Works (ABT 06), and General Conditions of Contract for Building and Civil Engineering Works and Building Services (AB 04).

The relationship between clients and technical consultants often entails a contract in accordance with General Conditions of Contract for Consulting Agreements for Architectural and Engineering Assignments (ABK 09). The so-called AMA system (General material and labour description) in which the industry regulates technical issues is often linked to the above-mentioned standard agreements. The AMA system also includes an administrative section (AMA AF). Consumer construction contracts are, meanwhile, regulated in the Consumer Services Act.

Landahl has extensive experience in the fields of construction contract law and consultancy law. We assist both principals, builders, and construction contractors throughout the construction process.

We can, for example, assist with contract negotiations and signing, and can also – thanks to our in-depth experience and wide-ranging know-how – predict and eliminate potential problems and settle issues between the parties at an early stage in the process.

Issues may arise as the construction project proceeds and Landahl’s attorneys have substantial expertise and experience of interpreting the standard agreements in this area and of advising on how ongoing construction projects should be handled.

And in the event of disputes arising, we have very considerable experience of and expertise in acting as legal representatives in construction contract disputes in courts of law and arbitration tribunals. We assist on both smaller consumer construction contracts and major projects, and in commercial construction contracts.
